Your Big Day: What to Expect at a Tennessee Adoption Finalization Hearing
Finalizing an adoption is a joyful and emotional milestone in the life of a family. In Tennessee, the adoption finalization hearing is the legal step that officially makes your child a permanent part of your family. While the process can feel intimidating, the hearing itself is typically short, meaningful, and celebratory. Learn more about Tennessee adoption law.
Here’s what you can expect as you prepare for your big day.
What is an Adoption Finalization Hearing?
The adoption finalization hearing is the court proceeding where a judge legally confirms the adoption. It's the final step in the Tennessee adoption process and marks the moment when the adoptive parents gain full parental rights. Once finalized, the adopted child is legally recognized as the child of the adoptive parents with all associated rights and responsibilities.
When and Where Does the Hearing Take Place?
In Tennessee, finalization hearings typically occur several months after the child is placed in the adoptive home. The timeline may vary depending on the type of adoption (foster, private, stepparent, etc.) and court scheduling.
The hearing usually takes place in a local chancery or circuit court, depending on the county. The judge presiding over the case may be familiar with your file or may be seeing it for the first time, but either way, the tone is usually warm and positive.
Who Needs to Attend the Hearing?
Typically, the following people attend the adoption finalization hearing:
Adoptive parents;
The child being adopted;
The adoption attorney or agency representative; and,
A Guardian ad Litem, if appointed.
Family members and close friends are often encouraged to attend as well. The court generally welcomes loved ones to witness and celebrate this special occasion.
What Happens During the Hearing?
The hearing itself is usually brief—often 15 to 30 minutes. Here’s a general overview of what to expect:
Swearing In: The judge or court clerk will ask those giving testimony to take an oath.
Questions from the Judge: You may be asked basic questions such as:
Why you want to adopt this child
Whether you understand the rights and responsibilities of adoptive parents
Whether you believe the adoption is in the best interest of the child
Legal Review: The judge will review the legal documents, including parental consents or termination of parental rights (TPR), background checks, and reports from social workers.
Issuance of the Final Decree: If everything is in order, the judge will sign the Final Decree of Adoption, making the adoption official.
Some judges invite the family to take a picture together in the courtroom to commemorate the moment. Check out our adoption hearing checklist.
How Long Does the Hearing Last?
Most adoption hearings last no more than 30 minutes. However, it’s wise to arrive early in case your case is called sooner, and to be prepared for potential delays due to other cases on the docket.
Note: Some judges prefer to complete adoption finalizations first, some prefer to complete them last, and still others will call them in the order of the day's docket. So, adoptive families should be prepared to wait for an hour or more, though hearing itself takes much less time.
What Should You Bring or Prepare?
Valid photo IDs for adoptive parents;
Any court or agency documents requested by your attorney;
A camera or smartphone for pictures (check with your attorney or the court first!); and,
Comfort items for younger children (snacks, toys, etc.)
Your attorney will let you know if any additional paperwork is required. Learn more about how we help with adoption preparation.
Making the Moment Special
The finalization hearing is a celebration. Some families choose to dress up, bring balloons or signs, or host a small gathering afterward. Taking photos with the judge or in front of the courthouse is a common and cherished tradition. See our tips for making adoption day memorable.
